IMPORTANT NOTICE TO THE STUDENT / PARENT / GUARDIAN / SPONSOR
This document sets out the complete Terms & Conditions under which La Europa Education provides its services. It is circulated to every prospective and enrolled student by email and/or WhatsApp as a matter of company policy. No physical or digital signature is required.
Please read this document carefully and in full before engaging our services, before submitting any document, and before making any payment. If any clause is unclear, you may request a written clarification from us before proceeding. If you would prefer this document explained to you in Hindi or Gujarati, please ask and we will arrange it.
The single most important thing to understand from this document is this: La Europa Education provides assistance — advisory, preparatory and support work. We do not decide admissions, we do not decide visas, and we do not guarantee any outcome. Those decisions belong entirely to the university and to the immigration authority of the destination country.
1. INTRODUCTION AND ABOUT US
1.1."La Europa Education" (hereinafter "LEE", "the Company", "we", "us", "our") is the brand under which Euroverse Service LLP (ACY-5677), a Limited Liability Partnership registered in India under the Limited Liability Partnership Act, 2008, having its principal place of business at Surat, Gujarat, India, carries on business.
1.2.Euroverse Service LLP is the contracting party. All contractual obligations under these Terms are undertaken by Euroverse Service LLP, all invoices are raised by Euroverse Service LLP, and all payments are receivable only by Euroverse Service LLP. "La Europa Education" is a brand name and is not a separate legal entity.
1.3.LEE is an independent overseas education advisory and application-support consultancy. We are not a university, not a college, not an educational institution, not a government body, not an embassy or consulate, not a licensed immigration lawyer or regulated immigration adviser of any jurisdiction, and not an agent of any government.
1.4.LEE holds admission-partner, representation or referral arrangements with certain universities and institutions in the study destinations it serves. The existence of any such arrangement does not make LEE a decision-making authority for that institution, and does not entitle LEE to influence, expedite or secure any admission decision.
1.5.LEE provides its Services in respect of study destinations worldwide. Its principal focus and depth of experience lie in the countries of Europe and the United Kingdom, and LEE additionally undertakes engagements for other destinations, including but not limited to the United States, Canada, Australia and New Zealand, and such other countries as LEE may accept from time to time. The specific country or countries covered by a particular Engagement shall be only those agreed in writing at the commencement of that Engagement, in accordance with Clause 4.4.
1.6.These Terms & Conditions ("Terms") govern the entire relationship between LEE and the Student in respect of the services described in Clause 5, and no other services.
2. DEFINITIONS AND INTERPRETATION
2.1.In these Terms, unless the context otherwise requires:
| Term | Meaning |
| Student | The individual availing or seeking to avail LEE's services, and where the Student is a minor or is financially supported by another person, includes their parent, guardian, sponsor or authorised representative. |
| Sponsor | Any person who funds, or undertakes to fund, the Student's education, living costs or fees, or who makes any payment to LEE on the Student's behalf. |
| Services | The three assistance services expressly listed in Clause 5, and nothing else. |
| Institution | Any university, college, business school, university of applied sciences, language school or other educational body to which an application is made or is contemplated. |
| Authority | Any embassy, consulate, high commission, visa application centre, outsourced visa partner (for example VFS Global, TLScontact, BLS International), immigration department, foreigners' office, ministry or other governmental or statutory body of any country. |
| Service Milestone | A defined stage of work, on the completion and delivery of which LEE becomes entitled to raise an invoice, as described in Clause 14. |
| Professional Fee | LEE's own service charge for the Services, exclusive of all Third-Party Fees and exclusive of taxes. |
| Third-Party Fee | Any amount payable to a person or body other than LEE, including but not limited to application fees, tuition fees, deposits, visa fees, biometric fees, blocked-account charges, insurance premiums, courier charges, translation charges, apostille or attestation charges, language-test fees, credential-evaluation fees and accommodation deposits. |
| Engagement | The relationship between LEE and the Student created by acceptance of these Terms under Clause 3, in respect of the specific country, course, Institution and intake agreed in writing. |
| Working Day | Any day other than a Sunday or a public holiday observed at LEE's Surat office. |
| Official Channels | The email addresses, WhatsApp number, telephone numbers and bank account of Euroverse Service LLP as published on LEE's website or stated on an official LEE invoice. |
2.2.In these Terms, unless the context otherwise requires: Words in the singular include the plural and vice versa. References to a statute include that statute as amended or re-enacted from time to time. "Including", "includes" and "in particular" are without limitation. Headings are for convenience only and do not affect interpretation.
3. ACCEPTANCE OF THESE TERMS (NO SIGNATURE REQUIRED)
3.1.As a matter of company policy, these Terms are issued to the Student in writing by email and/or WhatsApp at the commencement of the Engagement, and are additionally published on LEE's website.
3.2.The Student is deemed to have read, understood and unconditionally accepted these Terms upon the occurrence of any one or more of the following:
- submitting any document, information or credential to LEE for the purpose of an assessment or an application;
- authorising LEE, in writing or by any electronic message, to prepare or submit an application on the Student's behalf;
- making any payment, whether full or partial, of the Professional Fee or of any Third-Party Fee through LEE;
- continuing to avail the Services after receipt of these Terms.
3.3.Any of the above acts constitutes valid acceptance of an offer under Sections 2, 7 and 8 of the Indian Contract Act, 1872, and creates a legally binding agreement between the Student and Euroverse Service LLP without the requirement of a handwritten or electronic signature.
3.4.If the Student does not accept these Terms, the Student must inform LEE in writing within seven (7) days of receipt and must not submit any document or make any payment. In such an event the Engagement shall not commence and no liability shall arise on either side.
3.5.An electronic record of the email or WhatsApp transmission of these Terms shall be sufficient evidence of delivery and of acceptance, in accordance with the Bharatiya Sakshya Adhiniyam, 2023 and the Information Technology Act, 2000.
3.6.Where a Sponsor makes any payment to LEE or provides any financial document, the Sponsor is equally bound by these Terms and accepts them in the same manner, and the Student and the Sponsor are jointly and severally liable for all amounts payable to LEE.
4. ELIGIBILITY, ONBOARDING AND RIGHT TO DECLINE
4.1.The Student confirms that they are at least 18 years of age; or, if a minor, that these Terms are accepted on their behalf by a parent or lawful guardian who assumes full responsibility for the Student's obligations under these Terms.
4.2.LEE reserves the absolute right to decline or discontinue an Engagement, at its sole discretion and without assigning a detailed reason, including where the Student's academic profile, financial capacity, immigration history, language ability or documentation makes a successful outcome unlikely, or where the Student's conduct is abusive, dishonest or non-cooperative.
4.3.LEE's acceptance of an Engagement is not an assessment of, or an opinion on, the Student's likelihood of success, and must never be treated as such.
4.4.The Engagement is personal to the Student and relates only to the country, course, Institution and intake agreed in writing at commencement. It does not extend to any sibling, relative, friend or other person.
5. SCOPE OF SERVICES - THE THREE SERVICES WE PROVIDE
5.1.LEE provides three assistance services, and three only:
SERVICE A — Country and University Selection Assistance
SERVICE B — University / Institution Application Assistance
SERVICE C — Student Visa / Residence-Permit Application Preparation Assistance
Each of these is an assistance service. Anything not expressly described in Clauses 5.2, 5.3, 5.4 and 5.5 below is outside the scope of the Engagement and is dealt with in Clause 7.
5.2.SERVICE A — COUNTRY AND UNIVERSITY SELECTION ASSISTANCE
Within this Service, LEE assists the Student by:
- discussing the Student's academic background, budget, language ability, career objective and family circumstances, and explaining which study destinations may realistically suit that profile;
- explaining, on the basis of officially published information, the study system, typical course structure, medium of instruction, indicative tuition ranges and indicative living-cost expectations of the countries under consideration;
- explaining the published eligibility criteria, entry requirements, language requirements, intake calendars and application deadlines of Institutions under consideration;
- preparing a shortlist of Institutions and programmes for the Student's consideration, matched against the Student's stated profile and preferences;
- explaining, in outline and on the basis of officially published rules only, the study-related conditions attaching to a country's student status — for example published part-time work permissions and published post-study stay rules — strictly as general published information and never as advice, assurance or a projection of the Student's own future entitlement;
- informing the Student of the existence of any scholarship, fee-waiver or bursary scheme published by the Institution itself, and of its published eligibility criteria and deadline.
5.2.1.The final choice of country, Institution, course and intake is made by the Student alone. LEE's role is limited to presenting options and explaining published information. The Student is encouraged to independently verify all information on the official website of the Institution and of the relevant Authority before deciding.
5.3.SERVICE B — UNIVERSITY / INSTITUTION APPLICATION ASSISTANCE
Within this Service, LEE assists the Student by:
- preparing a document checklist against the Institution's published admission requirements;
- reviewing the Student's academic and supporting documents for completeness and formatting against that checklist;
- providing guidance on the drafting, structuring and presentation of a Statement of Purpose or motivation letter, curriculum vitae, and letters of recommendation — in every case on the basis of content, facts and experiences supplied by the Student, and never by inventing, embellishing or fabricating content;
- assisting the Student to complete and compile the application, and submitting it to the selected Institution(s) through the Institution's prescribed portal or channel using information reviewed and confirmed by the Student;
- tracking the application, following up with the Institution's admissions office, and communicating decisions, conditions, offers, deadlines and requests for further information to the Student;
- explaining the terms of any offer received, including conditions attached to a conditional offer, and the steps required to satisfy those conditions;
- assisting with acceptance formalities, explaining the Institution's deposit-payment procedure, and assisting the Student to obtain the final admission or enrolment letter, Letter of Acceptance, Confirmation of Acceptance for Studies or equivalent document, where applicable;
- assisting the Student to complete and submit an application for a scholarship or fee-waiver scheme published by the Institution, where the Student wishes to apply and is eligible under the published criteria.
5.3.1.The number of Institutions and applications covered by the agreed Professional Fee shall be stated in writing at commencement. Applications beyond that number constitute fresh professional work under Clause 14.7.
5.4.SERVICE C - STUDENT VISA / RESIDENCE-PERMIT APPLICATION PREPARATION ASSISTANCE
Within this Service, LEE assists the Student by:
- explaining the published student-visa, study-permit or residence-permit requirements of the destination country, as stated on the official website of the relevant embassy, consulate, ministry, immigration authority or official gazette;
- preparing a document checklist specific to the destination country, the visa category and the Student's circumstances;
- reviewing the Student's financial documents against the officially published financial thresholds, maintenance-period rules and blocked-account or proof-of-funds requirements, and explaining what those published rules require;
- providing guidance on the format, structure and content of covering letters, financial-explanation letters, sponsorship declarations, relationship affidavits and similar supporting statements — in every case on the basis of true facts supplied by the Student and the Sponsor;
- assisting the Student to complete the official online or offline visa application form accurately, using information provided and expressly confirmed by the Student, the Student remaining at all times the declarant and the person responsible for the truth of every entry;
- assisting with the booking of the visa appointment, biometric enrolment appointment and, where applicable, the interview slot, on the Authority's or visa partner's official platform;
- compiling, sequencing and quality-checking the final application file in accordance with the Authority's published checklist, and delivering the compiled file to the Student;
- preparing the Student for a visa interview, where the destination country conducts one, including mock practice and guidance on the published subject matter of such interviews;
- explaining post-decision formalities, including the procedure for collection of the passport, the conditions attached to the visa or permit as published by the Authority, and the published procedure for registration or residence-permit collection in the destination country.
5.4.1.The visa application is always the Student's own application. It is made in the Student's name, on the Student's declaration, and - where the Authority so requires - is signed, submitted and attended in person by the Student. LEE prepares and assists; LEE does not and cannot make a declaration on the Student's behalf, and does not represent the Student before any Authority.
5.4.2.Where an Authority requires the applicant to appear personally, to give biometrics, to attend an interview, to undergo a medical examination or to submit the file in person, the Student must do so personally. LEE does not and cannot attend in the Student's place.
5.5.GENERAL SUPPORT INCIDENTAL TO SERVICES A, B AND C
- coordination with the Institution and, where the Institution or Authority permits, correspondence on purely procedural matters;
- written and telephonic guidance during the period of the Engagement, during LEE's published working hours;
- a pre-departure procedural briefing limited to travel documentation, visa-condition compliance and the published registration formalities of the destination country;
- safe handling and return of documents entrusted to LEE, in accordance with Clause 11.6.
6. NATURE OF OUR ROLE — ASSISTANCE ONLY
6.1.This clause is fundamental to the Engagement and to the interpretation of every other clause in these Terms.
6.2.LEE provides assistance. LEE does not provide outcomes. Every service described in Clause 5 is advisory, preparatory, facilitative and supportive in nature. LEE's obligation is to apply reasonable professional care and skill to the preparation and support work; it is not an obligation to procure an admission, a scholarship, a visa, a permit, entry to a country, accommodation, employment or any other result.
6.3.The Student is the applicant. Every application prepared with LEE's assistance is the Student's own application. The Student is the person who makes the representations in it, who declares its contents to be true, and who bears responsibility for it before the Institution and the Authority.
6.4.LEE does not decide, and cannot influence, any decision. Admission is decided solely by the Institution (Clause 8). A visa or permit is decided solely by the Authority (Clause 9). LEE has no standing, no authority and no channel of influence in either process, and expressly disclaims any representation to the contrary made by any person.
6.5.LEE does not act as the Student's legal representative. LEE is not a law firm; its personnel are not advocates, solicitors, OISC-regulated advisers, Rechtsanwälte, avocats or licensed immigration consultants of any jurisdiction. Nothing communicated by LEE constitutes legal advice or legal representation in any jurisdiction.
6.6.Any opinion, estimate, indication, assessment or expectation expressed by LEE — as to the likelihood of admission, the likelihood of a visa, a timeline, a cost, a scholarship prospect or a work or stay-back entitlement — is a professional opinion formed on the basis of officially published criteria and past experience at that moment in time. It is never a promise, assurance, warranty or guarantee, and must not be relied upon as one.
6.7.The Student acknowledges that they have engaged LEE for professional assistance with full knowledge of the limits described in this Clause 6, and that no employee, counsellor, associate, referral partner or sub-agent of LEE has authority to widen those limits other than by a written confirmation from LEE's official email address.
7. SERVICES NOT PROVIDED — EXPRESS EXCLUSIONS
7.1.The Student expressly acknowledges that LEE does NOT provide, and has never represented that it provides, any of the following:
- Legal or immigration legal advice, or representation before any authority, court or tribunal.
- Permanent residence, settlement, citizenship, asylum, dependent, spouse, family-reunification, work-permit, job-seeker, investor, business, medical or tourist visa services of any kind.
- Appeals, administrative reviews, remonstrations, judicial reviews, re-consideration requests or representation of any kind following a visa refusal. LEE may, as a separate and separately quoted engagement, assist with the preparation of a fresh application; it does not conduct appeals.
- Job placement, part-time work arrangement, internship placement, or any assurance of employment during or after studies.
- Accommodation booking, tenancy arrangement, hostel allotment, or any assurance regarding accommodation availability, quality, cost, location or safety.
- Education loans, loan sanction assistance, financial products, foreign-exchange services, money-transfer services or blocked-account services. Any reference to a bank, non-banking financial company, blocked-account provider or forex provider is informational only, and is not a recommendation, endorsement, introduction for consideration, or guarantee.
- Airport pickup, travel booking, flight ticketing, SIM cards, or forex arrangement, unless separately agreed in writing as a distinct paid service.
- Health insurance, travel insurance or any insurance underwriting, broking or claims assistance.
- Language coaching or standardised test coaching (IELTS, TOEFL, PTE, German, French, or any other), and the conduct of any such test, unless separately agreed in writing as a distinct paid service under LEE's language and test-preparation division, which is governed by its own separate terms.
- Document procurement of any kind. LEE does not obtain, arrange, prepare, source or supply academic certificates, mark sheets, transcripts, degree certificates, bank statements, income proofs, income-tax returns, property valuations, chartered-accountant certificates, affidavits, employment letters, experience letters, gap-justification letters or any other document on the Student's behalf. All documents must be genuine and must originate from the Student, the Sponsor, or the lawful issuing authority.
- Attestation, apostille, notarisation, translation, sworn translation or credential-evaluation services. LEE may inform the Student of the competent authority or of an available third-party provider; LEE is not responsible for the acts, omissions, timelines, fees, accuracy or quality of any such provider.
- Post-arrival services in the destination country, including city registration, bank-account opening, residence-permit collection, tenancy disputes, university-administration issues, course changes, transfers, academic appeals or extension of stay. LEE's procedural briefing under Clause 5.5(iii) is informational only.
- Any service in respect of a country, course, Institution or intake not expressly agreed in writing at the commencement of the Engagement.
- Any assurance, projection or advice regarding the Student's future earnings, career outcome, settlement prospects, or the future immigration policy of any country.
7.2.Any assistance, information or courtesy extended by LEE that falls outside Clause 5 is provided gratuitously, without charge, without warranty and without liability of any kind, and does not extend the scope of the Engagement or create a precedent.
8. NO GUARANTEE OF ADMISSION
8.1.LEE does not and cannot guarantee admission to any Institution, nor any scholarship, fee waiver, bursary or ranking outcome. The decision to grant or refuse admission rests exclusively and absolutely with the Institution.
8.2.The Institution may, at its sole discretion and without giving reasons: refuse an application; issue a conditional offer; withdraw, revoke or lapse an offer; alter its entry requirements, fee structure, intake dates, course content, course delivery mode or course availability; cancel, merge or defer a programme; close an intake earlier than the published deadline; or change its scholarship criteria or quantum.
8.3.LEE has no control over, and accepts no liability for, the Institution's decisions, its internal processing times, technical failure or downtime of its portals, loss of documents in its systems, or errors, delays or omissions in its communications.
8.4.An offer of admission is granted subject to the Institution's own terms, and the Student's relationship with the Institution — including tuition liability, deposit forfeiture, deferral rules and refund policy — is governed by the Institution's own contract with the Student, to which LEE is not a party.
9. NO GUARANTEE OF VISA OR PERMIT
9.1.LEE does not and cannot guarantee the grant of a visa, study permit, residence permit or entry to any country. The grant, refusal, delay, cancellation, curtailment or revocation of a visa is the exclusive sovereign discretion of the Authority of the destination country.
9.2.A visa officer may refuse an application even where the file is complete, accurate and fully compliant with every published requirement. Grounds outside LEE's control include, without limitation: doubts as to the genuineness of the Student's intention to study; doubts as to the source, legitimacy or sufficiency of funds; academic-progression or credibility concerns; inconsistent or unsatisfactory interview answers; adverse immigration, travel or criminal history; security or public-health grounds; national-level policy, quota or cap changes; capacity constraints at a mission; or reasons the Authority is not obliged to disclose.
9.3.The Authority may change its rules, financial thresholds, documentation requirements, fees, appointment systems or processing procedures at any time, with or without notice, and with immediate or, in some cases, retrospective effect. LEE is not liable for the consequences of any such change, including the need to re-prepare a file.
9.4.Processing times published by any Authority are indicative only. LEE is not liable for delay in processing, unavailability of appointment slots, portal downtime, courier delay, mission closure, strike action, or loss of an academic intake resulting from any of the foregoing.
9.5.A visa refusal is not a deficiency of service by LEE. The Professional Fee is charged for the professional work of preparing, compiling and supporting the application, which stands fully performed irrespective of the decision of the Authority.
9.6.Entry to a country is separately controlled at the border. The grant of a visa does not guarantee entry, and a border officer may refuse entry notwithstanding a valid visa. LEE bears no liability in that event.
10. ACCURACY OF INFORMATION AND THIRD-PARTY SOURCES
10.1.LEE endeavours to base all country-specific and Institution-specific information it provides on official sources only — the websites, gazettes, circulars and published guidance of governments, ministries, embassies, consulates, immigration authorities, and the Institutions themselves.
10.2.Such information is nevertheless subject to change without notice, may be published only in a local language, may be interpreted differently by different officers, and may be applied differently in individual cases. Information provided by LEE is accurate to the best of its knowledge as at the date it is given, and is not warranted to remain accurate.
10.3.Where LEE provides a link, reference or contact to any third-party website, provider or resource, it does so for convenience only. LEE does not endorse and is not responsible for the content, accuracy, availability, security, fees or conduct of any third party.
10.4.The Student is expected and encouraged to verify all material information independently on the official source before making any financial commitment or irreversible decision.
11. STUDENT'S RESPONSIBILITIES AND WARRANTIES
11.1.The Student is solely and fully responsible for the truth, accuracy, completeness, authenticity and legality of every document, statement, disclosure and piece of information provided to LEE, to any Institution and to any Authority.
11.2.The Student warrants that they shall:
- provide all requested documents and information promptly, completely and in the format requested;
- disclose in full, at the very outset, all prior visa applications, refusals, rejections, withdrawals, cancellations, overstays, deportations, removals, entry bans, criminal proceedings, convictions, and any adverse immigration, academic or disciplinary history in any country whatsoever;
- disclose any medical condition, disability, pregnancy or special requirement relevant to the application, and any change in marital, dependency or employment status;
- disclose any academic gap, backlog, failed attempt, discontinued course or change of stream, and the true reason for it;
- read, review and confirm the accuracy of every application form, letter, declaration and document before it is submitted, the act of confirmation being the Student's own responsibility and not LEE's;
- attend all scheduled appointments, biometric enrolments, interviews and medical examinations punctually and personally;
- make all payments to Institutions, Authorities and third parties only through official channels and banking channels, and retain original receipts;
- respond to LEE's communications, and to any request from an Institution or Authority, within the timeline specified;
- settle every invoice raised by LEE on completion of a Service Milestone, within the period stated on that invoice;
- comply with all laws of India and of the destination country, and with every condition attached to the visa or permit granted;
- inform LEE immediately in writing of any change in circumstances, contact details, funding position or intention that could affect the application.
11.3.Non-disclosure is at the Student's sole risk. Where an application is refused, delayed or cancelled, or an admission or visa is revoked, wholly or partly because of information withheld, misstated or supplied late by the Student or the Sponsor, LEE bears no liability of any nature, and every invoice already raised remains fully payable.
11.4.LEE prepares and assists with applications on the basis of information supplied by the Student, and is under no duty to independently investigate, authenticate or verify any document or statement provided by the Student.
11.5.Parallel engagement. The Student shall disclose in writing, at the outset, whether any application to the same or another Institution or Authority has been made or is being made independently or through another consultant or agent. Undisclosed parallel applications frequently cause duplicate-application rejections, credibility findings and refusals, and any consequence of such non-disclosure is entirely at the Student's risk.
11.6.Custody of documents. Where the Student entrusts original documents to LEE, LEE shall issue an acknowledgement listing them, shall keep them securely, and shall return them on completion of the relevant Service Milestone or on written request. LEE's liability in respect of any original document is limited to the reasonable cost of obtaining a duplicate from the issuing authority. The Student must retain their own copies of everything provided to LEE.
12. DOCUMENT AUTHENTICITY — ZERO-TOLERANCE POLICY
12.1.LEE operates a strict zero-tolerance policy in respect of forged, fabricated, tampered, morphed, back-dated, fraudulently obtained or misrepresented documents, and in respect of false statements of any kind.
12.2.The Student expressly acknowledges and agrees that LEE shall never create, procure, arrange, alter, edit, back-date, inflate or facilitate any document or financial record, and shall never advise, encourage or assist the Student to make a false statement to any Institution or Authority. Any request to LEE to do so will be refused and may result in immediate termination under Clause 26.
12.3.If, at any stage, LEE forms a reasonable belief that a document or statement is not genuine, LEE shall be entitled to immediately suspend or terminate the Engagement and to decline to submit or continue with the application, without liability. All invoices raised in respect of work already performed shall remain fully payable.
12.4.The Student alone bears the entire consequence of any submission of a false or misleading document, including visa refusal, admission cancellation, entry bans of five to ten years or more, blacklisting in the Schengen area, the United Kingdom or any other jurisdiction, including the sharing of such adverse records between countries, prosecution and deportation. LEE disclaims all liability in this regard absolutely.
12.5.Where a document is provided by the Student in electronic form, LEE is entitled to rely on it as received, in the form received, without further verification.
13. ANTI-BRIBERY, ANTI-CORRUPTION AND ANTI-MONEY-LAUNDERING
13.1.LEE does not, under any circumstances, offer, pay, promise or accept any bribe, gratification, facilitation payment or unlawful inducement to or from any official of any Institution, Authority, embassy, consulate, visa centre or government body.
13.2.Any person who represents to the Student that a decision can be arranged, expedited, influenced or secured by payment is acting fraudulently and without any authority from LEE. The Student must report any such approach to LEE in writing immediately.
13.3.All payments to LEE must be made through lawful banking channels to the official bank account of Euroverse Service LLP. LEE does not accept cash beyond the limits permitted under Indian law, and does not accept payment from an unrelated third party without written explanation of the relationship.
13.4.The Student and the Sponsor warrant that all funds shown in any financial document, and all funds paid to LEE, are from lawful sources and are not the proceeds of any offence, and that the Student has complied with all applicable exchange-control regulations, including the Foreign Exchange Management Act, 1999 and the Liberalised Remittance Scheme.
14. PROFESSIONAL FEE — POST-SERVICE BILLING MODEL
14.1.LEE follows a post-service billing model. The Professional Fee is not collected in advance. LEE becomes entitled to raise an invoice only upon completion of a Service Milestone — that is, only after the corresponding professional work has actually been performed and delivered to the Student.
14.2.The Service Milestones applicable to the Student's Engagement, and the Professional Fee attributable to each, shall be communicated to the Student in writing (by email, WhatsApp, quotation or the Service Milestone & Fee Schedule) before that work is commenced, and shall form an integral part of these Terms.
14.3.A Service Milestone is treated as completed, and the corresponding Professional Fee as fully earned, on delivery of the professional work itself — for example, on delivery of the shortlist under Service A, on submission of an application to an Institution under Service B, on delivery of an offer or admission letter, or on delivery of the compiled visa file under Service C — and not on the outcome of any application. The outcome lies with the Institution or the Authority (Clauses 8 and 9) and is outside LEE's control.
14.4.Each invoice is payable within the period stated on it. Where an invoice for a completed Service Milestone remains unpaid, LEE shall be entitled to withhold commencement of the next Service Milestone and to suspend the Engagement until that invoice is settled. Any deadline, intake or appointment missed as a result of such non-payment is at the Student's sole risk.
14.5.All payments to LEE must be made only to the official bank account of Euroverse Service LLP, or by such other official mode as is stated on LEE's invoice. LEE shall not be liable for any payment made to a personal account, to an individual employee, to a referral partner or sub-agent, to any third party, in cash without a receipt, or to any account not stated on an official LEE invoice.
14.6.Every payment received by LEE shall be acknowledged by an official receipt or invoice issued in the name of Euroverse Service LLP. The Student must obtain and retain such receipt. Absence of an official LEE receipt shall be conclusive evidence that the payment was not received by LEE.
14.7.Unless otherwise stated in writing, the agreed Professional Fee covers only the Services listed in Clause 5 for the country, course, Institution count and intake agreed at commencement. Any additional country, additional Institution beyond the agreed count, additional intake, deferral, re-application, or re-submission after refusal constitutes fresh professional work and shall be separately quoted and separately invoiced.
14.8.A fee quotation is valid for thirty (30) days from the date it is issued, unless otherwise stated, and is subject to revision thereafter.
15. THIRD-PARTY FEES, TAXES AND CURRENCY
15.1.The Professional Fee is exclusive of all Third-Party Fees and exclusive of Goods and Services Tax and any other statutory levy, all of which shall be borne by the Student.
15.2.Third-Party Fees are payable by the Student directly to the third party wherever possible. Where, for practical reasons, a Third-Party Fee is routed through LEE at the Student's written request, LEE acts merely as a conduit and not as principal, and shall provide the corresponding third-party receipt.
15.3.All amounts quoted in a foreign currency are indicative. The actual rupee amount depends on the exchange rate, bank charges, remittance charges, card-issuer charges and intermediary-bank deductions prevailing at the time of the transaction, all of which are borne by the Student. LEE does not control and is not responsible for exchange-rate movement.
15.4.Any tax collected at source, withholding tax or bank levy applicable to a remittance is the Student's responsibility.
16. COMMISSION DISCLOSURE AND CONFLICT OF INTEREST
16.1.The Student is informed, transparently, that LEE may receive a commission or recruitment fee from certain Institutions in respect of students who enrol with them. This is a normal and lawful feature of the international education sector.
16.2.Receipt of such commission does not alter LEE's obligation to recommend only those Institutions and programmes that are genuinely suited to the Student's stated profile, budget and objective. Where the Student wishes to apply to an Institution with which LEE has no arrangement, LEE will say so and will nonetheless assist, subject to a separately agreed Professional Fee.
16.3.LEE does not receive, and will not accept, any commission or incentive from any bank, loan provider, forex provider, insurer, accommodation provider or blocked-account provider in a manner that would influence the information it gives to a Student.
16.4.The Student may at any time ask LEE, in writing, whether LEE has a commercial arrangement with a particular Institution, and LEE will answer truthfully.
17. REFUND POLICY
17.1.Because LEE charges only after the professional work has been performed and delivered (Clause 14.1), the question of a refund of the Professional Fee does not arise. Every amount invoiced by LEE represents consideration for professional services already rendered in full at the time of invoicing. Accordingly, the Professional Fee, once invoiced and paid, is not refundable under any circumstances.
17.2.Without limiting Clause 17.1, and for the avoidance of all doubt,
no refund of the Professional Fee shall be payable in any of the following circumstances, each of which arises
after the professional work has already been performed:
- refusal of admission by an Institution, or refusal of a scholarship;
- refusal, rejection, delay, revocation, curtailment or cancellation of a visa, study permit or residence permit by any Authority, or refusal of entry at the border;
- the Student's decision, after the work has been performed, to change course, Institution, country, intake or career plan, or to abandon the plan of studying abroad;
- the Student's failure to provide documents or information within the required timeline;
- the Student's failure to attend an appointment, biometric enrolment, interview or medical examination;
- submission by the Student of any false, forged, incomplete or misleading document or statement;
- non-disclosure by the Student of any prior refusal, ban, overstay or adverse history;
- the Student's failure to clear a required language or standardised test, or to satisfy a condition of a conditional offer;
- the Student proceeding independently, or through another consultant or agent, after engaging LEE;
- any change in the law, policy, financial threshold, quota or procedure of any country or Institution;
- any event of force majeure as described in Clause 25;
- termination of the Engagement by LEE under Clause 12.3 or Clause 26.2;
- the Student's dissatisfaction with an outcome, as distinct from a demonstrated failure of professional care and skill in the performance of the work itself.
17.3.Work not yet performed is not charged. Where the Student withdraws from the Engagement, no Professional Fee shall be invoiced in respect of any Service Milestone that LEE had not commenced as at the date of the Student's written withdrawal. In the exceptional event that any amount has been received by LEE in respect of a Service Milestone that was not thereafter commenced at all, that amount alone shall, at the Student's written election, be refunded or adjusted against a completed or future Service Milestone.
17.4.Third-Party Fees are not refundable by LEE under any circumstances. Application fees, tuition deposits, visa fees, biometric fees, courier charges, insurance premiums, translation, attestation, credential-evaluation and blocked-account charges, once paid to the Institution, Authority or provider, are governed exclusively by the refund policy of that Institution, Authority or provider. LEE has no control over, and gives no assurance regarding, whether, when, in what amount, or in which currency such a refund is made. LEE is neither a guarantor nor a surety nor an insurer for any third party.
17.5.Where a Third-Party Fee was routed through LEE and a refund is subsequently sanctioned by that third party, LEE shall pass on to the Student the amount actually received from that third party, after deduction of bank charges, foreign-exchange conversion losses, remittance charges and applicable taxes. LEE gives no assurance as to the timeline for such receipt.
17.6.Any amount payable by LEE under Clause 17.3 or Clause 17.5 shall be processed within thirty (30) Working Days of written approval or of actual receipt of funds (as applicable), to the original mode of payment or to the bank account of the person who made the payment, after deduction of transaction charges and applicable taxes.
17.7.All requests under this Clause 17 must be made in writing to
info.laeuropa@gmail.com, quoting the invoice reference and stating the reason.
18. LATE PAYMENT, SET-OFF AND RECOVERY
18.1.Where any invoice remains unpaid beyond the period stated on it, LEE may, without prejudice to any other right:
(a) suspend all work on the Engagement;
(b) withhold delivery of any prepared file, letter, offer letter or document until payment is received; and
(c) terminate the Engagement under Clause 26.2(iii).
18.2.LEE reserves the right to charge simple interest at 1.5% per month on any amount that remains outstanding for more than thirty (30) days from the invoice date, from the due date until actual payment.
18.3.LEE may set off any amount due to the Student against any amount due from the Student.
18.4.The Student shall bear all reasonable costs, including legal and collection costs, incurred by LEE in recovering an undisputed overdue amount.
19. TIMELINES, DEADLINES AND INTAKES
19.1.All timelines communicated by LEE regarding admission decisions, visa processing, appointment availability or document turnaround are indicative estimates only, derived from published information and past experience, and are not commitments.
19.2.Applications and visa files must be initiated with adequate lead time. Where the Student engages LEE, or provides documents, at a stage that leaves insufficient time before an intake, appointment or deadline, LEE shall use reasonable professional effort but accepts no liability whatsoever for loss of the intake or the deadline.
19.3.Several destination countries impose maintenance-period rules requiring funds to be held in a specified account for a specified continuous period before the application date. The Student is responsible for arranging and maintaining such funds in the prescribed manner. LEE shall explain the published rule; LEE is not responsible for the Student's inability or failure to comply with it.
19.4.Deferral of an intake, whether by the Student or by the Institution, may require a fresh application, a fresh visa file and fresh Third-Party Fees, and constitutes fresh professional work chargeable under Clause 14.7.
19.5.LEE is entitled to reasonable time to perform each Service Milestone. Requests for expedited handling are accommodated where practicable but are never guaranteed.
20. COMMUNICATION POLICY
20.1.LEE communicates with the Student by email, WhatsApp, telephone and in-person meetings. Written communication (email or WhatsApp) shall prevail over any oral statement.
20.2.No oral statement, verbal assurance, informal message or promise made by any individual — whether an employee, counsellor, associate, referral partner or sub-agent of LEE — shall bind LEE unless confirmed in writing from LEE's official email address. The Student is expressly advised not to rely on any assurance that is not in writing from an official LEE email address.
20.3.The Student must communicate only through LEE's Official Channels: laeuropaapplication@gmail.com for application matters, info.laeuropa@gmail.com for general and billing matters, ceo.laeuropa@gmail.com for grievances, and LEE's official WhatsApp and office numbers as published on LEE's website. LEE bears no responsibility for communication sent to, or received from, any unofficial channel or personal number.
20.4.The Student consents to receive service-related communication from LEE by email, WhatsApp, SMS and telephone, including transactional updates, document requests, invoices and deadline reminders. The Student may withdraw consent for promotional communication at any time by written request, without affecting service-related communication.
20.5.It is the Student's responsibility to keep their email address, mobile number and postal address current, and to check their inbox — including spam and promotions folders — regularly. LEE is not liable for any consequence arising from a communication that the Student did not read.
20.6.LEE endeavours to respond to written queries within two (2) Working Days. LEE's working hours and holidays are as published at its office and on its website.
20.7.LEE may record telephone or video calls for quality, training and record-keeping purposes. Where the Student objects, the Student must say so at the start of the call.
20.8.Where the Student has been introduced by a referral partner or sub-agent, the Student is nevertheless entitled and encouraged to communicate with LEE directly, and should verify any material representation directly with LEE at an official email address.
21. DATA PROTECTION AND PRIVACY
21.1.LEE collects, stores and processes the Student's and Sponsor's personal data — including identity, academic, financial, passport, travel, immigration and, where required, health data — solely for the purpose of providing the Services described in Clause 5 and for compliance with legal obligations.
21.2.By accepting these Terms in the manner described in Clause 3, the Student and the Sponsor give free, specific, informed, unconditional and unambiguous consent to such collection and processing, in accordance with the Digital Personal Data Protection Act, 2023.
21.3.The data may be shared, only to the extent necessary for the Services, with: Institutions and their admissions departments; embassies, consulates, visa application centres and immigration authorities; language-test and credential-evaluation bodies; insurance providers, banks and blocked-account providers where the Student has instructed such engagement; couriers; translators and attestation agencies; and LEE's professional advisers and auditors. Certain of these recipients are situated outside India, and the Student consents to such cross-border transfer where it is necessary for the application.
21.4.LEE shall not sell, rent or trade personal data, and shall not disclose it for any purpose unconnected with the Services, except where disclosure is required by law, by a court order, or by a competent authority.
21.5.LEE maintains reasonable technical, physical and organisational security safeguards. However, no method of electronic transmission or storage is entirely secure, and LEE does not warrant absolute security against unauthorised access, cyber-attack or data breach beyond its reasonable control.
21.6.LEE retains records for such period as is required for legal, regulatory, audit and legitimate business purposes, and thereafter erases or anonymises them.
21.7.The Student has the right to seek
access to, correction of, or erasure of their personal data, to seek information about its processing, and to
withdraw consent, by written request to
info.laeuropa@gmail.com. Withdrawal of consent may make it impossible for LEE to continue the Services, and in such event the Engagement shall stand terminated, with all invoices for completed Service Milestones remaining payable.
21.8.Grievances relating to personal data may be addressed to
ceo.laeuropa@gmail.com and shall be dealt with in accordance with Clause 28.
22. CONFIDENTIALITY
22.1.LEE shall treat all information and documents received from the Student and the Sponsor as confidential and shall not disclose the same except as permitted under Clause 21 or as required by law.
22.2.The Student shall treat as confidential all proprietary material of LEE, including checklists, templates, internal formats, guidance notes, sample letters, fee structures, commission structures, partner lists and pricing, and shall not disclose or circulate the same to any competitor, agent or third party.
22.3.These confidentiality obligations survive termination of the Engagement.
23. BRAND, TRADE MARKS AND INTELLECTUAL PROPERTY
23.1."La Europa Education", the La Europa logo, and all associated names, marks, devices, artwork, colour schemes and get-up (together, the "Marks") are proprietary marks used by LEE in the course of its business. The Marks are used by LEE with the authority and consent of their proprietor. Nothing in these Terms transfers, licenses or confers upon the Student any right, title or interest in the Marks.
23.2.The Student shall not, and shall not permit any other person to, use, adopt, register, apply to register, reproduce, imitate or display the Marks, or any name or mark deceptively or confusingly similar to the Marks, in any medium, whether as a business name, trade name, domain name, social-media handle, advertisement or otherwise.
23.3.Any unauthorised use of the Marks, and any use of a deceptively similar mark, is prohibited and shall be actionable at law, including by way of an action for passing off and for such other relief as may be available under the Trade Marks Act, 1999 and the common law of India.
23.4.All guides, checklists, templates, sample letters, formats, worksheets, presentations, country reference sheets and study material prepared or supplied by LEE remain the copyright of Euroverse Service LLP and are licensed to the Student for personal, non-commercial use in connection with the Student's own application only. They may not be copied, resold, redistributed, published or shared with any third party or competing consultancy.
23.5.Content authored by the Student (such as the Statement of Purpose) remains the Student's property; LEE's contribution is limited to editorial, structural and presentational guidance.
24. TESTIMONIALS, PUBLICITY AND SOCIAL-MEDIA CONDUCT
24.1.LEE shall use the Student's name, photograph, admission or visa-approval outcome, or testimonial for promotional purposes only where the Student has given separate, specific, written consent for that purpose. Such consent may be withdrawn in writing at any time, and LEE shall thereafter cease further use, without obligation to recall material already in circulation.
24.2.The Student agrees to raise any concern or complaint through the grievance procedure in Clause 28 before publishing any statement about LEE on any public platform.
24.3.Nothing in this clause restricts the Student from making a truthful statement or a fair review, or from approaching any statutory forum. However, the publication of any false, misleading or defamatory statement regarding LEE, its personnel or its services shall entitle LEE to terminate the Engagement under Clause 26.2 and to pursue all civil and criminal remedies available in law.
25. FORCE MAJEURE
25.1.LEE shall not be liable for any delay in, or failure of, performance of the Services arising from any cause beyond its reasonable control, including without limitation: any act, omission, policy change or discretionary decision of any Institution or Authority; suspension or closure of visa operations; changes in immigration law, visa quotas, caps, financial thresholds or entry rules; war, hostilities, civil unrest, terrorism, riot or strike; epidemic, pandemic or public-health emergency; natural disaster, flood, earthquake or fire; internet, portal, server or power failure; postal, courier or transport disruption; bank or payment-system failure; or any order of a court, government or regulatory body.
25.2.On the occurrence of a force majeure event, LEE's obligations shall stand suspended for its duration. Invoices already raised for completed Service Milestones remain payable, no refund shall arise, and no claim for consequential loss shall lie.
25.3.If a force majeure event continues for more than ninety (90) days, either party may terminate the Engagement by written notice, and Clause 17 shall govern.
26. SUSPENSION AND TERMINATION OF ENGAGEMENT
26.1.By the Student. The Student may terminate the Engagement at any time by written notice. No further Service Milestone shall thereafter be commenced or charged; all invoices already raised for completed Service Milestones remain fully payable, and Clause 17 shall govern.
26.2.By LEE. LEE may suspend or terminate the Engagement immediately, by written notice and without liability, where the Student or the Sponsor:
- submits or attempts to submit any false, forged, tampered or misleading document or statement;
- withholds material information, including prior refusals, bans or adverse history;
- fails to settle any invoice raised for a completed Service Milestone, or any Third-Party Fee;
- fails persistently to respond, to provide documents, or to attend appointments;
- behaves abusively, threateningly, defamatorily or dishonestly towards LEE's personnel;
- engages another consultant or agent in parallel for the same application without prior written disclosure to LEE;
- requests LEE to do anything unlawful, or anything contrary to Clause 12 or Clause 13;
- breaches any material provision of these Terms;
- makes or publishes a false, misleading or defamatory statement regarding LEE on any platform, including social media.
26.3.In the event of termination under Clause 26.2, all Professional Fees invoiced but unpaid shall become immediately due and payable, no amount already paid shall be refundable, and LEE reserves all rights and remedies available in law.
26.4.On termination for any reason, LEE shall return the Student's original documents in its custody, on written request, within a reasonable period, subject to settlement of all undisputed outstanding invoices.
26.5.Termination shall not affect Clauses 12, 13, 14, 17, 18, 21, 22, 23, 24, 27, 28, 29 and 30, which shall survive.
27. LIMITATION OF LIABILITY AND INDEMNITY
27.1.The Services are advisory, preparatory and facilitative in nature. LEE's obligation is to exercise reasonable professional care and skill; it is not an obligation to achieve any particular result (Clause 6).
27.2.LEE shall not be liable for:
- refusal, delay, revocation, curtailment or cancellation of any admission, scholarship, visa, permit or entry;
- any act, omission, error, delay, negligence, insolvency, closure, accreditation loss, fee increase or misrepresentation of any Institution, Authority, bank, insurer, courier, translator, attestation agency, test-conducting body, credential-evaluation body, blocked-account provider, accommodation provider, loan provider or other third party;
- any change in law, policy, immigration rule, financial threshold, fee structure, quota or exchange rate;
- loss of academic intake, loss of academic year, loss of employment, loss of earnings, loss of opportunity, loss of reputation, mental distress, or any indirect, incidental, special, punitive or consequential loss of any nature;
- any loss arising from information, document or instruction supplied by the Student or the Sponsor that is inaccurate, incomplete, false, unauthentic or delayed;
- any loss arising from the Student's reliance on an oral assurance not confirmed in writing under Clause 20.2, or on a representation by a referral partner or sub-agent not confirmed by LEE in writing;
- any matter falling within the exclusions listed in Clause 7;
- any event of force majeure under Clause 25.
27.3.Aggregate liability cap. Without prejudice to the foregoing, LEE's total aggregate liability arising out of or in connection with the Engagement, whether in contract, tort, statute or otherwise, shall in no event exceed the amount of the Professional Fee actually received by LEE from the Student in respect of that Engagement. Third-Party Fees, tuition fees and deposits are expressly excluded from the computation of this cap.
27.4.Indemnity. The Student shall indemnify and hold LEE harmless against any claim, loss, penalty, cost or proceeding arising from (a) any false, forged or misleading document or statement supplied by the Student or the Sponsor; (b) any breach by the Student of Clause 12 or Clause 13; or (c) any breach by the Student of the laws or visa conditions of any country.
27.5.Any claim against LEE must be brought within twelve (12) months of the date on which the Student first became aware, or ought reasonably to have become aware, of the circumstances giving rise to it.
27.6.Nothing in these Terms shall exclude or limit any liability that cannot lawfully be excluded or limited under the applicable law of India, including under the Consumer Protection Act, 2019. These Terms are to be read subject to, and in conformity with, the Student's statutory rights.
28. GRIEVANCE REDRESSAL
28.1.LEE is committed to the fair and prompt resolution of complaints. Any grievance regarding the Services, invoices, payments, data protection or the conduct of personnel must be raised in writing by email.
28.2.All grievances must be addressed to:
Email: ceo.laeuropa@gmail.com
La Europa Education (Euroverse Service LLP), 303, Panvel Point, Mota Varachha, Surat, Gujarat, India
28.3.Grievances received at this email address are attended to directly by the management of Euroverse Service LLP. Grievances raised by telephone, WhatsApp voice note, in person, or on social media will not be treated as formally lodged, and the Student will be requested to submit them in writing at the above email address.
28.4.A written grievance shall be acknowledged within three (3) Working Days and shall be resolved, or a substantive written response given, within thirty (30) days of receipt.
28.5.The Student agrees to raise and exhaust this internal grievance procedure before initiating any external proceeding or publication.
29. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION
29.1.These Terms and the Engagement shall be governed by and construed in accordance with the laws of India.
29.2.The parties shall first attempt to resolve any dispute amicably through the grievance procedure in Clause 28, and thereafter by mutual discussion, within a period of thirty (30) days.
29.3.Failing amicable resolution, any dispute, controversy or claim arising out of or relating to these Terms, including its validity, interpretation, breach or termination, shall be referred to arbitration by a sole arbitrator appointed by mutual consent, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Surat, Gujarat, India, and the language of arbitration shall be English. The arbitral award shall be final and binding.
29.4.Subject to Clause 29.3, the courts at Surat, Gujarat, India shall have exclusive territorial jurisdiction over all matters arising out of or in connection with these Terms.
29.5.Nothing in this Clause 29 shall restrict the Student's statutory right to approach a Consumer Commission of competent jurisdiction under the Consumer Protection Act, 2019.
30. GENERAL PROVISIONS
30.1.Entire agreement. These Terms, read together with LEE's written Service Milestone & Fee Schedule, quotation or invoice, constitute the entire agreement between the parties and supersede all prior discussions, representations, brochures, advertisements, social-media content, website content and oral statements.
30.2.Amendment. LEE may revise these Terms from time to time. A revised version shall be circulated by email and/or WhatsApp and shall be effective in respect of an ongoing Engagement only from the date of such circulation, and shall not operate retrospectively to the prejudice of the Student. Continued availing of the Services after circulation shall constitute acceptance of the revised Terms.
30.3.Severability. If any provision of these Terms is held invalid, unlawful or unenforceable by a competent authority, that provision shall be severed and the remaining provisions shall continue in full force.
30.4.No waiver. LEE's failure or delay in enforcing any provision shall not constitute a waiver of that or any other provision.
30.5.No agency or partnership. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between LEE and the Student.
30.6.Assignment. The Student may not assign or transfer the Engagement or any rights under it. LEE may assign the Engagement to a successor entity of the same business upon written notice.
30.7.Referral partners and sub-agents. Where a referral partner, sub-agent or associate has introduced the Student to LEE, that partner is an independent contractor and is not authorised to make any representation, promise, commitment or fee quotation on LEE's behalf, nor to collect any Professional Fee on LEE's behalf. LEE is bound only by what is confirmed in writing from its official email address. Any payment made to a referral partner or sub-agent is not a payment to LEE.
30.8.Third-party rights. No person other than the Student, the Sponsor and LEE has any right to enforce any provision of these Terms.
30.9.Language. These Terms are issued in English. A Hindi or Gujarati translation may be provided for convenience; in the event of any inconsistency, the English version shall prevail.
30.10.Headings. Clause headings are for convenience of reference only and do not affect interpretation.
30.11.Electronic form. These Terms are issued and accepted in electronic form and are valid and enforceable notwithstanding the absence of a physical or electronic signature, in accordance with the Information Technology Act, 2000 and the Indian Contract Act, 1872.
31. NOTICES
31.1.Any notice under these Terms shall be in writing and shall be sent by email to the address last notified by the recipient, or by registered post or courier to the address last notified.
31.2.A notice sent by email is deemed received on the next Working Day after despatch, provided no delivery-failure message is received. A notice sent by registered post or courier is deemed received on the fifth (5th) Working Day after despatch.
31.3.Notices to LEE shall be addressed to info.laeuropa@gmail.com, with a copy to ceo.laeuropa@gmail.com in the case of a grievance or a legal notice.
32. STUDENT'S ACKNOWLEDGEMENT
